We are committed to protecting the privacy, confidentiality and security of the personal information we held by complying with the requirements of Personal Data (Privacy) Ordinance (Chapter 486 of the laws of Hong Kong) with respect to the management of personal information.  We are equally committed to ensuring that all our employees uphold these obligations.

 

Purposes:

Your personal information collected and held by us will be used for the purposes of:

  • providing services to you;

  • replying to your enquiries;

  • the compliance with our regulatory obligations to conduct client due diligence and anti-money laundering checking to assess the risks of money laundering and terrorist financing;

  • the evaluation of your application to a position with our firm;

  • the administration of our firm;

  • sending appropriate marketing and event invitation to you (subject to your prior consent); or

  • the monitoring, analysing and planning of our business.

 

Cookies:

Our website does not use cookie files to store and track information about you or your actions.

 

Necessity for the provision of personal information:

If you decide to engage us for our services, you are required to provide such personal information as may be required by us for the compliance with our regulatory obligations to conduct client due diligence and anti-money laundering checking to assess the risks of money laundering and terrorist financing.  Such information may include your personal details, financial position and shareholding interests.  If such information is not provided, the regulations imposed on us may not permit us to provide any services to you.

 

Retention:

We will only retain your personal information for as long as is necessary for the above purposes, including for the purposes of complying with any legal, regulatory, accounting or reporting requirements.

 

Sharing with third parties:

We will not provide your personal information to third parties for direct marketing or other unrelated purposes without your consent.  We use third parties who provide support services to us and may share your information with them, for example computer and other technology suppliers may have access to your personal information when providing software support.  We also use various ancillary services, for example, Microsoft email system and cloud storage systems. The use of these ancillary services may require your personal information to be held in the cloud on infrastructure managed by the relevant service provider.  If required by law or regulation, we may also require to share your personal information with government, regulators, courts and other third parties.

 

Right to access and correct:

You have the right to request access to and correction of information held by us about you.  If you wish to access or correct your personal information, please contact our principal Derek Tsang at derektsang@derektsanglaw.com.  We reserve the right to charge a fee for access to your personal information held by us to the extent permitted by law or regulation.
